Delhi High Court Grants Protection to Live-in Couple Who Left Their Spouses

The Delhi High Court has granted police protection to a live-in couple who had left their respective spouses and were facing threats from the woman’s husband and family members. The Court emphasized that the right to life and personal liberty under Articles 19 and 21 of the Constitution applies equally to all citizens, regardless of their relationship status.
Justice Saurabh Banerjee observed that whether individuals are married or in a live-in relationship is not a relevant consideration when it comes to protecting their fundamental rights. The Court made it clear that consenting adults have the autonomy to choose their partners and cohabit without interference.
According to the facts presented, the woman had allegedly suffered abuse in her marriage since 2016 and later chose to live with her partner. Due to continued threats and intimidation from her husband and relatives, the couple relocated and approached the Court seeking protection.
Taking note of the situation, the Court directed the police to provide necessary protection to ensure the couple’s safety. It also instructed that the couple should keep authorities informed of any change in location to facilitate continued protection.
This ruling reinforces the judiciary’s consistent stance that constitutional morality prevails over social morality, and that adult individuals have the fundamental right to live with a partner of their choice without fear, irrespective of societal or familial objections.
